Mediation is a process of resolving disputes that is used by both businesses and individuals. It is a conflict resolution process guided by neutral professional facilitators - the mediators.
Only one brief court appearance is required when the mediation process is completed, as contrasted with multiple court appearances for a litigated divorce.
At Macktaz & George LLC Divorce Mediation the couple meets with both mediators to work out the issues regarding their divorce. Mediation can also be useful to resolve conflict after a divorce has been finalized or to settle disputes between unmarried people.
Although attorney's are not regularly present in the mediation session, each person is free to have an attorney present and/or consult with an attorney before or after each session.
Mediation avoids adversarial legal battles that can be financially draining and emotionally devastating to you and your family.
As impartial and neutral facilitators the focus of this co-mediation practice is to assist clients to reach a fair and lasting agreement that benefits themselves and their children.
Because mediation is a voluntary process clients are encouraged to consult other professionals including tax preparers, appraisers, and attorneys. Mediation is a confidential process of negotiation based on full disclosure of all assets, liabilities, income, and all relevant information.
Civility is a crucial requirement for success. Clients are required to sign a Divorce Mediation Agreement in which they acknowledge that mediatiors do not represent either or both as attorneys in connection with their divorce. They further agree that all communications in the process, including notes, homework, and other written material are completetly confidential both by the agreement as well as by R.I.G.L. (Section 9-19-44). Clients agree that they will not seek to obtain the testimony of the mediatiors or the disclosure of mediation files in connection with any court process.
